Paid Leave for Kids Going Back-to-School

Is your kid's school operating on an alternate day (or other hybrid-attendance) basis?  Alternate day basis means students alternate between in-school and remote learning days and can only show up to school on their assigned in-school day.

 

If yes, you are eligible for paid leave under the Families First Coronavirus Response Act (FFCRA) on days when your child is not permitted to attend school in-person and must  engage in remote learning.  You must actually need the leave to care for your child when there is no other suitable person who can.  FFCRA recognizes the schools as essentially “closed” when your child is not permitted to attend school in person.

My school offers in-school and/or remote learning for the fall. I chose remote learning because I'm afraid my child may contract COVID-19. Since I chose remote learning, can I still take paid leave under FFCRA?

No, you may not take paid leave under FFCRA. Your child’s school is not considered “closed” due to COVID-19 related reasons; it is open.  If your child is at home because you have chosen for the child to remain home, you are not entitled to FFCRA paid leave.  However, if your child is placed under a quarantine order or has been advised by a health care provider to quarantine, you may be eligible to take paid leave to care for your child.
